Final payment is due prior to departure and should be paid to the master upon boarding if prepayment has not been made. This must be in the form of travelers checks or cash.

NOT INCLUDED IN FEE: Crew gratuity (customarily approximately 15%, but left to the Charterers' discretion), Special request wine and liquors that are not normally part of Standard Ship's Bar, Dockage at client's request, Dinners ashore, shore side transfers and excursions, or shore lodging.
NOTE: The British Virgin Islands govt. charges a passenger, departure and cruising tax while cruising through British waters. This tax is generally passed on to guests. Approx. $4/pp/day, $5/pp departure tax, plus a per cruise fee of $35.00 for a total of approximately $45.00 (depending on the vessel length).

BROKER REPRESENTATION: The OWNER and the CHARTERERS each acknowledge that IN THE WILD ADVENTURES is entitled to the customary and usual brokerage fees in connection with this yachting vacation, and any extensions, renewals or subsequent charters requested by the CHARTERERS for a period of two years. It is further understood that IN THE WILD ADVENTURES has acted solely as a broker to arrange this charter and forwarding monies in accordance with the Disbursement of Funds herein stated, and is in no way responsible for actions of the CHARTERERS, OWNER, YACHT or Captain and Crew. Further, IN THE WILD ADVENTURES shall not be responsible or liable for loss, injury, death or damage to the persons or property suffered or incurred by any person in connection with this Agreement.

TRIP INTERRUPTION INSURANCE: The purchase of trip, health, accident, baggage and cancellation insurance is recommended. Please note as appropriate below:

TERMS AND CONDITIONS: The executed Yacht Charter Agreement and deposit must be returned to In The Wild Adventures upon receipt of which the charter booking will be confirmed (Deposit of 50% of fee required). Please make the check payable to In The Wild. The deposit will be held in a trust account and will be disbursed to the owner/master of the yacht ten (10) days prior to the charter date. The deposit is NONREFUNDABLE except under the following circumstances:

A: If the Broker and Master of Yacht agree in writing that a refund should be made.
B: If the Yacht becomes unfit for charter.
C: If, upon cancellation by the charter of his booking, the Yacht is rebooked for the number of days of the original booking, or if rebooking only for a portion thereof, the deposit will be refunded pro rata.
D: If there is a change in Yacht Master or if it is agreed between the broker and the Yacht's owner/master that the crew has become unfit and the charterer desires to cancel for this reason.

The Owner agrees to provide the yacht with a proper crew comprised of at least, but not limited to, a captain and cook. The Captain shall be competent and hold an appropriate skipper's license. It is agreed that the Charterer may determine the general movements, program and destination of the yacht within limits of this Agreement, but it is understood that the Captain is in full command, and the Charterer agrees to depend upon the Captain for safe navigation of the vessel, and at all times to abide by his judgment as to sailing, weather, anchorage, clearance, etc.

Should the yacht, during the period of this charter party, be lost, stranded or disabled by an act of God, fire, perils of the sea, or other unavoidable accident rendering her unfit for the use or purpose of the charter and not brought about by act or fault of the Charterer, charter hire shall cease from the time thereof and neither of the parties shall be liable for the loss, damage, expense or inconvenience resulting there from. If the boat suffers mechanical breakdown that cannot be repaired within 24 hours, Charterer may cancel and receive a pro rata refund.

The Charterer agrees to restrict the cruising of the yacht to the cruising area described herein above. Charterer agrees to be responsible for and to replace or make good any injury to the yacht, her furnishings and equipment, caused by himself, or by and of his party, less ordinary wear and tear. The yacht shall be surrendered free of any indebtedness that may have been incurred on account of the Charterer. Use or possession of illegal drugs, including marijuana, on board the vessel shall result in immediate termination of the charter with forfeiture of monies paid.

The Owner agrees to keep the yacht fully insured against Fire, Marine and Collision risks, and with Protection and Indemnity coverage, for the term of this Charter, this policy to be held by him as full protection for any and all loss or damage that may occur to, or by the yacht during the Charter period, and the Charterer shall thereby be relieved of any and all liability for such loss or damage. It is further agreed and expressly understood that the Charterer is not the agent, servant or employee of the Owner in any way whatsoever, and that the Owner shall not be responsible for any injuries or damages caused by the Charterer or any member of his party.

To the true and faithful performance of the foregoing Agreement, the said parties bind themselves, their heirs, executors, administrators and assigns, each to the other.
